The General Terms and Conditions of the pasaric.hr online store have been drawn up in accordance with the Consumer Protection Act, the Personal Data Protection Act, and the Electronic Commerce Act, applicable in the Republic of Croatia.

These general terms and conditions apply to the use of the pasaric.hr online store at the domain www.pasaric.hr, including all sub-pages, and to the purchase of products available therein. Please read these terms and conditions carefully before using the online store. Your agreement to the terms and conditions set out herein is a prerequisite for making a purchase.

All products listed on www.pasaric.hr whose titles contain original part numbers are aftermarket products; the original numbers serve as reference only.


GENERAL TERMS AND CONDITIONS OF USE OF THE ONLINE STORE

The online store available at the domain pasaric.hr has been established by Vulkanizacija Pasarić d.o.o., with its registered office at Zagrebačka 123, Šibice, 10290 Zaprešić, Croatia, registered in the court register of the Commercial Court in Zagreb under number (MBS) 081218899, OIB 01268930195, VAT ID HR01268930195 (hereinafter “Vulkanizacija Pasarić d.o.o.” or “Seller”). Vulkanizacija Pasarić d.o.o. provides an online store service at the domain www.pasaric.hr. The service consists of providing information services, content management, conducting financial transactions, selling goods between users of the online store — i.e. between the Buyer and the Seller — and organizing the delivery of the items sold. The online store service may be used in the territory of the Republic of Croatia and in other countries worldwide.

You accept these General Terms and Conditions electronically when confirming your order in the online store. We also advise you to read the Data Protection and Privacy Policy as well as the Cookie Policy, as these documents also apply to your use of the online store.

The Buyer, as a user, agrees to use the online store exclusively in accordance with applicable regulations, for browsing published content, purchasing available products by submitting legally valid orders, and communicating with the Seller.

The services of the pasaric.hr online store do not include costs incurred by you in using computer equipment and other electronic devices and services to access the pasaric.hr online store. Vulkanizacija Pasarić d.o.o. is not responsible for telephone, data traffic, or any other costs that may arise when placing an order, browsing the content of the online store, or using the services available therein.


CHANGES TO THE GENERAL TERMS AND CONDITIONS

The version of the General Terms and Conditions of Use of the Online Store currently published on this page shall always be considered the applicable version. In the event of a dispute, the version that was in effect at the time of purchase and to which you, as a user, expressed your agreement at the time of submitting your order shall apply.

We hereby inform you that the General Terms and Conditions of Use of the Online Store may be amended periodically in order to comply with changes in legislation and/or our business processes. For technical reasons, we are unable to notify every user of any potential changes; therefore, we recommend that you read this text each time you use the online store in order to familiarize yourself with any possible changes.

Vulkanizacija Pasarić d.o.o. reserves the right to modify or discontinue (temporarily or permanently) any products or services it provides, as well as to change the content of the online store, without prior approval or notice, in accordance with good business practice.


CONCLUSION OF THE PURCHASE AGREEMENT

While browsing the online store, you are free to select the items you wish and add them to your cart. This action is in no way binding. Once you have selected the items you wish to purchase and are certain you want to buy them, you proceed to the order process, during which you enter all the information required to complete the order, confirm your agreement to the General Terms and Conditions of Use of the Online Store and, depending on the chosen payment method, complete the payment. The actions you have taken and confirmed during the order submission process are considered to constitute the conclusion of a purchase agreement and are as such binding.

The price of products listed in the online store includes VAT and constitutes an invitation to users to purchase the goods at that price. Ordered goods are delivered at the prices and conditions applicable in the online store on the date the order is submitted, regardless of the prices and conditions applicable on the date of delivery.

These General Terms and Conditions form an integral part of the purchase agreement concluded through the online store.

After submitting your order using the online store interface, you will receive an automatically generated order receipt confirmation (hereinafter “Confirmation”) at the email address you entered during the order process. The order receipt confirmation does not constitute confirmation of the conclusion of a purchase agreement by the Seller; it is solely a document confirming receipt of the order.

The Seller reserves the right to decline a received order if, due to extraordinary circumstances, it is unable to fulfill the order in accordance with the quality standards of the pasaric.hr online store. The Seller is not obliged to conclude a purchase agreement based on a received order in cases where it cannot fully fulfill its contractual obligations. The purchase agreement is considered concluded by the Seller at the time of dispatch of the goods, of which you will be notified by a separate email.


PRODUCT PRICES AND PAYMENT METHODS

All product prices in the online store are expressed in Euros (EUR), with the equivalent value shown in Croatian Kuna (HRK), and include VAT. Product prices are the same for all payment methods and are visible on the product page and in the cart when finalizing the order. The price of the product does not include the cost of delivery, which is calculated separately in the last step of the order after the user enters the desired delivery address. The Seller reserves the right to change prices without prior notice.

In exceptional cases of an administrative error in displaying the price of a product on the online store pages, we are not obliged to conclude a purchase agreement on unfavorable terms. Should such a case arise, we will offer you the opportunity to purchase the product at the correct price, without any obligation to accept such an offer. If you do not accept the offer, the amount paid will be refunded to you if payment has already been made on your part.

Products remain the property of the Seller until full payment has been received pursuant to the concluded purchase agreement, regardless of whether the goods have been delivered.

Payment may be made by credit or debit card (Visa, MasterCard, Maestro, American Express, Diners) at the time of finalizing the order in the online store, or by bank transfer using internet banking or a general payment slip. When paying by credit or debit card, installment payment is available exclusively to users paying with cards issued by Croatian banks. Payment may also be made by bank transfer or cash on delivery.

The pasaric.hr online store operates in accordance with the Consumer Protection Act, the Croatian law protecting the fundamental rights of consumers when purchasing products and services.


TERMINATION OF THE PURCHASE AGREEMENT

You have the right, without stating a reason, to terminate the purchase agreement within 14 days from the date of receipt of the goods, or after submitting the order if you change your mind before the goods are delivered.

In order to exercise the right to unilateral termination of the Purchase Agreement, you must submit a notice to that effect before the expiry of the aforementioned period to the email address vulkanizacija@pasaric.hr as a reply to the order confirmation you received at your email address.

In the event of termination of the agreement, each party is obliged to return to the other what it received under the Agreement. Pursuant to Article 72 of the Consumer Protection Act, you are required to return the received goods to the address: Vulkanizacija Pasarić d.o.o., Zagrebačka 123, Šibice, 10290 Zaprešić.

Incorrectly ordered products may be returned to our address at your own expense.

A prerequisite for unilateral termination of the Agreement is that the goods have not been used and are, where possible, in their original packaging or are appropriately packed. If the goods have been used (diminution in value), upon receipt of the returned goods we will assess the condition of the goods based on visible signs of use and accordingly determine what percentage of the refund will be paid to you, in accordance with the diminution in value table (HERE). In such situations, we will contact you and attempt to find the most mutually acceptable solution.

No later than 14 days from the date on which we received your notice of the decision to terminate the agreement, provided that you have fulfilled your obligation to return the delivered goods, we will process your refund using the same payment method you used when placing the order.

Unfortunately, we are unable to refund any additional costs resulting from your explicit choice of transport method, nor any other costs associated with the return process. For shipments sent via cash on delivery, please provide the IBAN to which the refund is to be made.

The Seller reserves the right to and ensures a refund to the buyer if any of the items is unavailable.


EXCHANGE OF PRODUCTS FOR ANOTHER PRODUCT

If you ordered a product that does not suit you and wish to exchange it for another, you may do so as follows:

— Send a request via email to vulkanizacija@pasaric.hr for the original product to be collected from your address (provided that you adequately pack the goods for return in transport packaging). The return of goods is arranged via our contracted partner DPD at our request. After inspection of the returned item, we will notify you of the refund to your account. Return of a product is only possible if the product has not been used and is in its original packaging or is otherwise properly packed. The amount you paid for the previous order will be refunded to you, and you may order the desired item through a new order and payment. The cost of shipping the replacement product is borne by the Buyer.


COMPLAINTS REGARDING DEFECTIVE GOODS

In the event that you receive defective goods, you have the right to submit a complaint or claim regarding the goods within the statutory period in accordance with the Consumer Protection Act.

In accordance with Article 10 of the Consumer Protection Act, you may submit your complaints to the email address vulkanizacija@pasaric.hr or by post to: Vulkanizacija Pasarić d.o.o., Zagrebačka 123, Šibice, 10290 Zaprešić, Croatia. We will respond to all received complaints as promptly as possible, and no later than within 15 days of receipt of the complaint, and will resolve your complaint in the most favorable manner possible.

In the event of a complaint regarding defective goods, the return procedure is as follows: after receiving the complaint, in agreement with you, we will send a courier service to your address to collect the package and return it to our address.

A complaint will be considered valid if, upon inspection of the product and, if necessary, additional expert assessment, it is determined that it meets the conditions for a valid complaint in accordance with the Obligations Act and the Consumer Protection Act.

If the complaint is found to be valid, we will, at our expense, replace the goods with identical goods free of defects, or refund the full amount paid for the product, including delivery costs.

In the event that the complaint is not valid — i.e. if the consumer’s complaint is rejected — the buyer who submitted the complaint shall bear the cost of re-delivery of the purchased product to the buyer’s address.


ONLINE DISPUTE RESOLUTION

In accordance with European Union regulations, the pasaric.hr online store participates in the resolution of consumer disputes for products and services purchased online, which buyers may submit online.

European Union Regulation No. 524/2013 on online resolution of consumer disputes (Online Dispute Resolution platform) has been applicable since 9 January 2016.

Pursuant to Article 14(1) of that Regulation, traders established in the European Union who engage in online sales contracts are required to provide, in an easily accessible place on their websites, an electronic link to the Online Dispute Resolution Platform (ODR Platform).

DELIVERY

Delivery is carried out within Croatia.

Delivery costs

The delivery cost is €5 for all of Croatia and applies to products that can be purchased through the pasaric.hr online store. This price does not apply to other products featured on the pasaric.hr website, for which the price depends on the size and weight of the package; you can find out the cost by sending an enquiry to vulkanizacija@pasaric.hr or via the Contact form.

VAT is included in the stated delivery prices.

Delivery process and timeframe

Delivery within Croatia is carried out by our contracted partner DPD.

The standard delivery time for Croatia is 24 to 48 hours for orders placed on business days. For orders placed on Fridays after 9:00 AM, as well as during weekends and public holidays, the delivery time is 24 to 48 hours from the beginning of the next business day. The stated delivery timeframe is calculated from the moment payment is received.

In the case of delivery to islands (Croatia), due to logistical limitations, delivery is made within 3 to 7 days, depending on the location. If you wish to arrange a specific delivery time, please indicate this in the “Note” field when placing your order so that we can pass your request on to the courier service. Further arrangements will be made directly with you by our contracted partner.

All products will be protected and packed in such a way that they cannot be damaged by normal handling during transport.

The stated delivery time is calculated from the moment the parcel is collected by the courier and does not include our production and packing time.

After your order has been dispatched, you will receive an email with a tracking number and tracking instructions so that you can check the current location of your parcel at any time.
